Terms of Service

1. Acceptance of Terms

By accessing or using the Qulu platform at qulu.co.za ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Account Registration

To access certain features of the Service, you must create an account. When registering, you agree to:

• Provide accurate, complete, and current information.
• Be at least 13 years of age. Users under the age of 18 must have the consent of a parent or legal guardian to use the Service, in compliance with POPIA Section 34.
• Keep your login credentials confidential and not share your account with others.
• Notify us immediately of any unauthorised use of your account.

You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Free vs Pro Features

Qulu offers both free and paid (Pro) tiers of service:

• Free tier: access to a selection of past papers, limited daily downloads, basic quizzes, and progress tracking.
• Pro tier: unlimited access to all past papers and memoranda, unlimited downloads, advanced quizzes with detailed analytics, adaptive testing, priority support, and additional study tools.

We reserve the right to modify which features are included in each tier at any time. Existing Pro subscribers will be given reasonable notice of any changes that materially affect their subscription.

4. Payment Terms

Pro subscriptions are available on a monthly or annual basis. Payments are processed securely through PayFast. We also accept bank deposits (EFT) for annual subscriptions — please contact us for banking details.

• Pricing: all prices are displayed in South African Rand (ZAR) and include VAT where applicable.
• Billing: subscriptions are billed at the start of each billing period. Your subscription will automatically renew unless cancelled before the renewal date.
• Refunds: in accordance with the Consumer Protection Act (CPA), you have a 7-day cooling-off period after your initial subscription purchase during which you may request a full refund, provided you have not substantially used the Pro features during that period. After the cooling-off period, refunds are not available for the current billing period.
• Cancellation: you may cancel your Pro subscription at any time. Your Pro access will remain active until the end of your current billing period.

5. Acceptable Use

When using the Service, you agree not to:

• Share your account credentials with others or allow multiple people to use a single account.
• Use automated tools, bots, scrapers, or other software to access, collect, or download content from the Service.
• Redistribute, republish, or resell any content obtained from the Service without our written permission.
• Attempt to bypass download limits, security measures, or access controls.
• Use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service.
• Upload or share harmful, offensive, or inappropriate content.
• Interfere with other users' ability to use and enjoy the Service.

6. Intellectual Property

Past examination papers and official memoranda are the intellectual property of the Department of Basic Education (DBE) and the Independent Examinations Board (IEB). These documents are made available on Qulu for educational purposes in accordance with fair use principles.

The Qulu platform itself — including its design, code, quizzes, adaptive testing algorithms, study tools, and original content — is the intellectual property of Qulu Education and is protected by South African copyright law. You may not copy, modify, distribute, or create derivative works from the platform without our written permission.

7. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. While we strive to ensure the accuracy of all educational content, we do not guarantee that:

• The Service will be uninterrupted, error-free, or completely secure.
• All past papers, memoranda, or quiz answers are 100% accurate or complete.
• Use of the Service will guarantee any specific academic results.

To the maximum extent permitted by South African law, Qulu Education shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

8. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe that you have violated these Terms. Grounds for termination include but are not limited to:

• Sharing account credentials or allowing unauthorised access.
• Scraping, automated downloading, or systematic collection of content.
• Any form of abuse, harassment, or misconduct on the platform.
• Providing false information during registration.

Upon termination, your right to access the Service will immediately cease. If your account is terminated for a violation of these Terms, you will not be entitled to a refund of any subscription fees.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from or related to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of South Africa.
